This case involves a residential development on a known contaminated site in the Ironbound Section of Newark, with disparate impact on Environmental Justice (EJ) community. EELC filed a Motion to Intervene in the State’s action against Potentially Responsible Parties (PRPs). EELC appeared for oral argument re: Motion to Intervene October 25, 2019. Motion to Intervene granted. Complaint filed. Discovery exchanged. Case Mgt Conference held remotely, March 23, 2020, resulting in extended discovery schedule.
Status:
On July 20, 2020, parties agreed to another extension, so the State will have more time to add parties and complete discovery. On September 11, 2020, the State proposed another extension for more time to complete discovery (especially document production) and to add parties. On December 2, 2020, the State made a motion to amend its complaint to add individuals, estates, and companies to its list of potentially responsible parties (as defendants). EELC’s continued efforts to get the State to expand the named defendants in this case has had a positive outcome. The State’s motion was granted and it filed an amended complaint. Cross-motion to file amended answer granted.
