EELC recently submitted a joint protest letter to the Federal Energy Regulatory Commission (FERC) on behalf of clients Central Jersey Safe Energy Coalition, Food & Water Watch, NY/NJ Baykeeper, and Princeton Manor Homeowners’ Association, opposing Transco’s second request for extension of time to build the unnecessary and environmentally disastrous Northeast Supply Enhancement (NESE) project. EELC argued that Transco had not met its burden to show good cause for an extension, because it had made no effort, let alone a good faith effort, to move forward with the project in three years.

EELC also submitted evidence from a local landowner that Transco had abandoned its rights to a necessary access road, demonstrating that Transco had taken affirmative actions to end the project. EELC also argued that FERC’s necessity determination is stale, because over the four years since the Commission granted the certificate, demand projections for natural gas in lower New York have continually decreased.
